From Latin petitĭo, the petition is the request action (request or sue someone to do something). It is also known as a petition to the sentence with which it is requested, to the writing that makes an order and, within the scope of right , to the brief presented before a judge.
For example: "I will send a petition to the municipality to prune the entrance tree", "Please, ask for the health of my sister in the requests of the Our Father", “My lawyer gave a petition to the judge to request more time to prepare the case”.
In the legal framework, the petition is a right that assumes that all person You can go to the competent authorities for any reason of collective or general interest. The concept is usually linked to document that is presented before an authority and that is signed by many people: "The neighbors delivered a petition to the commissioner to request greater police presence in the streets", "The governor received the petition signed by fifteen mayors and promised to take it into account".
In this sense we also have to state that in Spain there is what is known as the right to petition. It is a right, included in the Constitution itself, by means of which any person can go to the public authorities to account for a fact or to be able to demand that they act in a certain line.
Individuals or legal entities, regardless of their nationality, and even both individually and collectively can exercise the aforementioned right. In the event that the petition itself is addressed to the Senate, it can be presented either in writing or in person in what is the General Register of the said chamber.
The document must have a series of data and essential elements so that it can take its course: identity of the applicant or applicants, address, nationality, recipient and the object itself requested. In this way, fulfilling the aforementioned requirements, the petition will be analyzed by the Petitions Committee and then followed by the Senate to later give an answer to the person who exercises the right.
The technology allows, at present, requests to be generated and transmitted through Internet . This implies that the petition does not even appear on a paper with the handwritten signature of the interested parties, but is sent by email or web form: “Yesterday I received an email inviting me to sign a petition on the Greenpeace site to protest against whaling”.
Specifically, taking into account both issues, we can therefore establish that basically today the requests can be classified into two large groups. On the one hand, there would be those that are made in writing and on the other hand, those that are undertaken using the Internet.
